romHEX14 SOFTWARE LICENSE AGREEMENT & TERMS OF USE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the romHEX14 software (“Software”), you (“User”) agree to be bound by this License Agreement and Terms of Use (“Agreement”).

If you do not agree to these terms, do not install or use the Software.

2. LICENSE GRANT (LGPLv3-BASED)

romHEX14 includes components licensed under the GNU Lesser General Public License version 3 (LGPLv3).

  • You are granted a non-exclusive, non-transferable license to use the Software.
  • You may modify and redistribute LGPL-covered components only in compliance with LGPLv3.
  • Any modifications to LGPL libraries must remain under LGPLv3.
  • Proprietary components of romHEX14 remain the exclusive property of the developer and are NOT covered by LGPL.

A copy of the LGPLv3 license is provided with the Software.

3. SOFTWARE PURPOSE

romHEX14 is an engineering and diagnostic tool intended for professional and educational use only.

The Software may:

  • Modify ECU data
  • Affect vehicle performance and safety systems

Improper use may result in serious damage, injury, or legal consequences.

4. NO WARRANTY

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND.

To the fullest extent permitted by law, the developer disclaims all warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

No guarantee is made that:

  • The Software is error-free
  • The Software will function with any specific ECU or vehicle
  • Results will be safe or compliant with regulations

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The developer shall NOT be liable for any damages, including but not limited to:

  • Vehicle damage
  • Engine or transmission failure
  • Battery or electrical damage
  • Data loss
  • Personal injury or death
  • Financial or business losses

This applies under any legal theory, including contract, tort, or strict liability.

Use of the Software is entirely at your own risk.

6. USER RESPONSIBILITY

You agree that:

  • You are solely responsible for your use of the Software
  • You understand the risks of ECU modification
  • You will comply with all applicable laws
  • You possess sufficient technical knowledge

7. INDEMNIFICATION

You agree to fully indemnify and hold harmless the developer from any claims arising from your use or misuse of the Software.

8. NO RIGHT TO SUE

To the maximum extent permitted by law, you waive any right to bring claims against the developer.

If any claim is allowed, liability is limited as stated above.

9. GOVERNING LAW

This Agreement is governed by the laws of: The Kingdom of Thailand

All disputes shall be resolved exclusively in Thai courts.

10. SEVERABILITY

If any provision is invalid, the remaining provisions remain enforceable.

11. TERMINATION

Violation of this Agreement results in automatic termination. You must stop use and delete the Software.

12. ENTIRE AGREEMENT

This is the complete agreement between you and the developer.
